Just when you thought the marina battle was over…. (at least, that’s what the developer wants everyone to think).
Yesterday, on 5 May 2020, SKP filed its Appeal submissions with the High Court. A copy of the submissions are available here.
SKP’s High Court Appeal submissions follow months of hard work and preparation - and present what SKP believe is its best case and opportunity to have the Kennedy Point marina resource consent application reheard by the Environment Court.
We hope you enjoy reading the submissions and that this latest significant development provides further comfort that that our battle to protect Waiheke Island and the environment of the Hauraki Gulf is certainly not over yet. Now, more than ever, the Covid-19 pandemic has shown us all that what matters most is the health of each and every one of us, and the health and well being of our precious environment.
Kennedy Point Bay, the Waiheke environment, securing free access to our beaches, and protecting the Waiheke community way of life is worth fighting for.
Kennedy Point Boat Harbour Ltd and Auckland Council are expected to file their reply submissions by Tuesday, 9 May 2020. The hearing is currently scheduled for Tuesday, 2 June 2020 and Wednesday, 3 June 2020.
We are currently waiting to hear from the High Court as to whether the hearing will be conducted remotely or whether the hearing will be in person. Much of this will depend on the Covid-19 restriction levels expected for June 2020. We will keep you updated once we have further confirmation from the High Court.
